Does the "Voetstoets" clause still apply to lease agreements?

By common law, a landlord must supply property fit for which it's let. Many lease agreements contain a Voetstoets clause which means that the tenant will accept the property in the current state and that it will be fit for the tenant's requirements. The Rental Housing Amendment Bill now requires that the landlord maintains and places the property fit for the purpose for which it was let. Tenants will also have to ensure that they are not placing too many people in the property.
